For hospices, the Bipartisan Budget Act of 2018 required early hospital discharges to hospice to<\/p>\n<p>be paid at a per diem daily rate in lieu of the full diagnosis-related group (DRG) rate beginning Oct. 1. Accordingly, in the Hospital Inpatient Prospective Payment System 2019 final rule scheduled for publication in the Aug. 17 Federal Register, the\u00a0<strong>Centers for Medicare &amp; Medicaid Services<\/strong>\u00a0expands Medicare\u2019s Postacute Care Transfer Policy to include discharges to hospice. It already included discharges to home health.<\/p>\n<p><strong>Price tag:<\/strong>\u00a0CMS expects the change, effective for discharges Oct. 1 and after, to reduce hospital spending by $240 million in fiscal year 2019, it says in the hospital rule.<\/p>\n<p><span style=\"color: #ffffff;\"><strong>Downside:<\/strong>\u00a0<\/span>\u201cWhile this change does not directly impact payments made from Medicare to hospice providers, the hospice community has reasonable concern that it may delay (and potentially eliminate some) admissions to hospice care,\u201d warns the\u00a0<strong>National Association for Home Care &amp; Hospice<\/strong>. That because \u201chospitals will now have the financial incentive to retain some patients on service for longer lengths of time prior to discharge,\u201d the trade group says.<\/p>\n<p><span style=\"color: #ffffff;\"><strong>Another downside:<\/strong><\/span>\u00a0CMS will apply the transfer proration policy to all 280 DRG groups, instead of starting out with just 10 like in home health.<\/p>\n<p><span style=\"color: #ffffff;\"><strong>Upside:<\/strong><\/span>\u00a0\u201cCMS is defining a hospital to hospice transfer as a direct to hospice transfer, which will limit the applicability to only those hospital discharges that occur on the same date as the patient begins hospice care (the effective date of hospice election),\u201d NAHC says in its member newsletter.<\/p>\n<p>Commenters on the hospital proposed rule cited numerous reasons the transfer policy shouldn\u2019t apply to hospice discharges. For example, one commenter \u201cprovided academic research demonstrating the numerous patient care benefits related to fasttrack discharges from hospitals to hospices,\u201d the rule notes. Another \u201cprovided analysis to demonstrate that the proposed application of the postacute care transfer policy to hospice discharges could potentially negatively impact up to 25 percent of hospice admissions nationally, with some providers experiencing rates as high as 33 percent.\u201d<\/p>\n<p>Despite the variety of arguments against the practice, CMS said it disagrees \u201cthat the postacute care transfer policy creates a perverse incentive to keep patients in the hospital longer than necessary. Our longstanding view is the policy addresses the appropriate level of payment once clinical decisions about the most appropriate care in the most appropriate setting have been made.\u201d<\/p>\n<p>CMS points out that BBA 18 requires the Medicare Payment Advisory Commission to \u201cconduct a detailed evaluation of the implementation and impacts of this provision. Specifically, such a report must address whether the timely access to hospice care has been affected through changes to hospital policies or behaviors.\u201d The report\u2019s \u201cpreliminary results\u201d are due to Congress by March 21, 2020, according to the hospital final rule.<\/p>\n<p>Other transfer policy actions include:<\/p>\n<ul>\n<li><span style=\"color: #ffffff;\"><strong>The OIG has announced a new topic<\/strong><\/span>\u00a0for its Work Plan, \u201cHospitals\u2019 Compliance with Medicare\u2019s Transfer Policy With the Resumption of Home Health Services and the Use of Condition Codes.\u201d Under the transfer policy, \u201cthe hospital can apply specific condition codes to the claim and receive the full DRG payment,\u201d the OIG says on its Work Plan website. \u201cThe hospital is responsible for coding the bill on the basis of its discharge plan for the patient or adjusting the claim if it finds out that the patient received postacute care after the discharge.\u201d<\/li>\n<\/ul>\n<p>The watchdog agency plans to assess whether Medicare appropriately paid hospitals\u2019 inpatient claims \u201cwhen (1) patients resumed home health services after discharge or (2) hospitals applied condition codes to claims to receive a full DRG payment.\u201d<\/p>\n<ul>\n<li><span style=\"color: #ffffff;\"><strong>The OIG has announced another Work Plan<\/strong>\u00a0<strong>topic<\/strong><\/span>\u00a0related to the hospital transfer policy, \u201cIncreased Payments For Transfer Claims With Outliers.\u201d By reducing the threshold above which a claim qualifies as an outlier, the application of the outlier methodology can result in an increase in the outlier payment in transfer cases, the OIG indicates. \u201cWe will produce a report describing the extent to which additional Medicare outlier payments negate the reduction in \u2026 payments of transfer claims,\u201d the agency says.<\/li>\n<li><a href=\"https:\/\/www.supercoder.com\/coding-newsletters\/my-homecare-week-alert\/referrals-referral-limiting-transfer-policy-hits-hospices-this-fall-158516-article\"><i><span style=\"font-weight: 400;\">Source- SuperCoder<\/span><\/i><\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Plus: OIG examines HH transfer policy.
