{"id":230,"date":"2018-05-15T14:55:07","date_gmt":"2018-05-15T14:55:07","guid":{"rendered":"https:\/\/advantagehcconsulting.com\/blog\/?p=230"},"modified":"2018-05-15T14:55:07","modified_gmt":"2018-05-15T14:55:07","slug":"conditions-of-participation-dont-let-simple-address-mistakes-torpedo-your-survey","status":"publish","type":"post","link":"https:\/\/advantagehcconsulting.com\/blog\/2018\/05\/15\/conditions-of-participation-dont-let-simple-address-mistakes-torpedo-your-survey\/","title":{"rendered":"Conditions of Participation: Don&#8217;t Let Simple Address Mistakes Torpedo Your Survey"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-231\" src=\"https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP.jpg\" alt=\"\" width=\"564\" height=\"375\" srcset=\"https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP.jpg 1300w, https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP-300x199.jpg 300w, https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP-768x510.jpg 768w, https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP-1024x680.jpg 1024w, https:\/\/advantagehcconsulting.com\/blog\/wp-content\/uploads\/2018\/05\/COP-210x139.jpg 210w\" sizes=\"auto, (max-width: 564px) 100vw, 564px\" \/><\/p>\n<p><span style=\"color: #ffffff;\"><strong><em>Learn from one agency\u2019s citation under the new CoPs.<\/em><\/strong><\/span><\/p>\n<p>The new Home Health Conditions of Participation that took effect in January are complex and overwhelming, but there\u2019s one new requirement that is easy to get right \u2014 if you know the ropes.<\/p>\n<p>Under the Patient\u2019s Rights CoP 484.50(a)(1)(ii), the home health agency must provide \u201ccontact information for the HHA administrator, including the administrator\u2019s name, business address, and business phone number in order to receive complaints.\u201d<\/p>\n<p><strong><span style=\"color: #ffffff;\">Pitfall:<\/span>\u00a0<\/strong>In a recent HHA survey, a surveyor cited an agency for not furnishing the administrator\u2019s business address in the Notice of Rights. \u201cThe agency assumed the patient knew the administrator\u2019s address was the agency address\u201d printed on all their forms, etc., relates attorney\u00a0<strong>Robert Markette Jr.\u00a0<\/strong>with\u00a0<strong>Hall Render\u00a0<\/strong>in Indianapolis.<\/p>\n<p><span style=\"color: #ffffff;\"><strong>Do this:\u00a0<\/strong><\/span>\u201cEven though this will seem redundant, state the address again\u201d with the other administrator contact information, Markette advises.<\/p>\n<p><strong><span style=\"color: #ffffff;\">That\u2019s not all:<\/span>\u00a0<\/strong>In addition to actually providing the administrator info and everything else included in the Patient\u2019s Rights CoP, the agency must document that it provided the notice before treatment commenced, points out attorney\u00a0<strong>Liz Pearson\u00a0<\/strong>with\u00a0<strong>Pearson &amp; Bernard\u00a0<\/strong>in Edgewood, Kentucky. Specifically, the CoPs specify that agencies must \u201cprovide the patient and the patient\u2019s legal representative (if any), the &#8230; information during the initial evaluation visit, in advance of furnishing care to the patient.\u201d<\/p>\n<p>To prove it fulfilled this requirement, Pearson suggests agencies use \u201can overall form completed of the explanation of the rights,\u201d including the administrator\u2019s contact information, said. \u201cThe patient and or caregiver sign and date this form and note the time to show that it occurred before any treatments,\u201d she says.<\/p>\n<p>This fulfills the requirement in 484.50(a)(2) to \u201cobtain the patient\u2019s or legal representative\u2019s signature confirming that he or she has received a copy of the notice of rights and responsibilities.\u201d<\/p>\n<p><strong><span style=\"color: #ffffff;\">Another address risk:<\/span>\u00a0<\/strong>In 484.50(c)(10), the\u00a0<strong>Centers for Medicare &amp; Medicaid Services\u00a0<\/strong>also specifies that \u201cthe patient has the right to be advised of the names, addresses, and telephone numbers of the following Federally-funded and state-funded entities that serve the area where the patient resides:<\/p>\n<p>(i) Agency on Aging,<br \/>\n(ii) Center for Independent Living,<br \/>\n(iii) Protection and Advocacy Agency,<br \/>\n(iv) Aging and Disability Resource Center; and<br \/>\n(v) Quality Improvement Organization.\u201d<\/p>\n<p>Names and phone numbers aren\u2019t enough.
